The Conway’s and Ms. Evans at this point sued the state of Utah in trial court for their right to practice polygamy based off of their religious beliefs. At this point the Conway’s and Ms. Evans would like to appeal the trial court decision. Issue: This memorandum will discuss statutes, and case law Utah may use in the appeal against our clients claims of constitutional violations, and religious rights to carry out polygamy as a religious right. Discussion: When discussing the issue of polygamy, the one case ruling mostly, and heavily relied on is in Reynolds Conway. This was the first case to weigh in on Utah’s anti-bigamy laws to state that they are constitutional. Further when Chief Justice Waite delivered the opinion of the court in discussion of the opinion further discussed if Mormons or the sects that are part of the religion practicing polygamy should be exempt from the law. The state of Utah may use this in our current case to try and show and or justify why Ms. Evans, Mr. amp; Mrs. Conway should not have the right to be married in a polygamous marriage, or granted a religious exemption. Lastly in Reynolds Chief Justice Waite compared polygamy as â€Å"a criminal act† which is also where the state of Utah will weigh in on this wording as well for the defense. The state of Utah also relies heavily on Utah Const. art. III,  § 1, in Utah’s Constitution stating â€Å"First: Perfect toleration of religious sentiment is guaranteed. No inhabitant of this State shall ever be molested in person or property on account of his or her mode of religious worship; but polygamous or plural marriages are forever prohibited†, and Utah’s anti-polygamy statute, Utah Code Ann. 76-7-101(1)(2)(3) stating â€Å"(1) A person is guilty of bigamy when, knowing he has a husband or wife or knowing the other person has a husband or wife, the person purports to marry another person or cohabits with another person, (2) Bigamy is a felony of the third degree, and (3) It shall be a defense to bigamy that the accused reasonably believed he and the other person were legal ly eligible to remarry† to make their standing that in the state of Utah a polygamous marriage is not valid, or constitutional, and a felony offense of the third degree. There have been several other cases besides Reynolds that have been in objection to polygamy. Potter v. Murray City, 585 F. Supp. 1126 (D. Utah 1984) is an example that the state will use as well. In Potter a Mormon police officer was discovered to be practicing polygamy and was fired. The dissenting judge on this case Judge Christensen claimed he was not weighing heavily on Reynolds to render any decision on this current case stating that he had â€Å"largely ignored† the holding in Reynolds to look at the issue in Potter. Potter at 45. In the end though when giving his decision, he still reverted back to Reynolds stating that it was still good law, and that Utah still held interest in the fact that the prohibition of polygamy should still stand. Reynolds not only is good and strong case law that stands, and is upheld in most if not all polygamy and bigamy cases, not only did it stand and was upheld in State v.

However, James would not be vying against the typical candidate. The 66-year-old James was about to face the fight of his political life thanks to freshmen City Councilman Cory Booker. The main character, Janie, get married three times in her lifetime. Janie is a very attractive woman and practically can get who she wants, but she is looking for a special somebody. Most people get married once, but Janie just couldn’t find the right person to spend the rest of her life with. Janie uses a peach tree as her symbol for a perfect man. Janie lives a life of uncertainty. She wishes to be married to her peach tree, but she cannot seem to run into him. Janie isn’t afraid of waiting for her ideal husband. Janie goes from marriage to marriage trying to find not only the perfect soul mate, but she also wanted to find herself. Janie had a hard time trying to be who she really is when she had her grandmother choosing her husband for her. Janie’s mother and grandmother had such a difficult life. Janie has her grandmother to take care of her, but she cannot do t hat forever. Janie’s grandmother pushed Janie to limits because she wanted Janie to have a life that wasn’t like her own or her mother’s. The theme of this story is love comes with compromise and honesty in a relationship. Marriage promises change, but it will remain loveless without equality and respect. Janie’s first marriage with Logan Killicks fails because Logan and her grandmother neglect to display any respect for what Janie wants out of a marriage. Janie’s grandmother’s selfish act contributed to the marriage because she forces Janie to marry Logan for the sake of her own comforts rather than Janie’s. As stated in the book, â€Å"So you don’t want to marry off decent like, do yuh? You just wants to hug and kiss and feel around with the first one man and then another, huh? You want me to suck the same sorrow yo’ mama did, eh? Mah ole head ain’t gray enough. Mah back ain’t bowed enough to suit yuh!â € (13-4). This quote shows how much her grandmother doesn’t want her to have the marriage she wants. Janie wants the hugs and the kisses, which is what makes her dream marriage seem so incredible. Janie wants to marry because she loves that person, she doesn’t want to marry out of convenience. Janie’s grandmother lived in a time where love didn’t exist and that is what makes her push Janie to marry Logan. During those times it was hard to find a marriage between African American women that contained love. Logan further aggravates the marriage because he expects Janie to show her appreciation for what he has done for her. Logan feels that he does Janie a huge favor by marrying her, but in all actuality, Janie is miserable. Logan has no respect for Janie’s feelings. Although Logan tries to be polite to her there is no sincerity in what he does because he just doesn’t care. Again Logan feels he’s doing Janie a favor. As Boston Globe s taff member, Renee Graham, writes about an interview by Valerie Boyd, she reveals that Hurston writes from experience, â€Å"She often worked as a maid and may have endured an abusive common-law marriage to a man who, Boyd posits, may have provided bitter inspiration for the cruel Logan Killicks in â€Å"Their Eyes Were Watching God.† (Hurston, who married not wisely but often, officially had three husbands. I believe you can do it. I know what was done for me. The transformative power of an effective teacher is something almost all of us have experienced and understand on a personal level. If we were particularly fortunate, we had numerous exceptional teachers who made school an exciting and interesting place. Those teachers possessed a passion for the subjects that they taught and genuine care for the students with whom they worked. They inspired us to play with ideas, think deeply about the subject matter, take on more challenging work, and even pursue careers in a particular field of study. Some exceptional teachers achieve celebrity status, such as Jaime Escalante, the math teacher who inspired the film Stand and Deliver, but thousands of unsung heroes go unrecognized in their remarkable work with students on a daily basis. ? II. Qualities of an Effective teacher Think back to when you were in school. Who was your favourite teacher? Who was the teacher you dreaded having? Almost everyone will instantly be able to answer these two questions. We’ve all had terrific teachers and, unfortunately, most of us have had teachers that were not effective. So what qualities does an effective teacher have that an ineffective teacher does not? The answer is that it takes a perfect blend of several qualities to create a truly effective teacher who can have a lasting impact on virtually every student. In this article, we examine ten qualities that virtually every effective teacher will possess. a)An effective teacher loves to teach. The single most important quality that every teacher should possess is a love and passion for teaching young people. Unfortunately, there are teachers who do not love what they do. This  single factor can destroy a teacher’s effectiveness quicker than anything else. Teachers who do not enjoy their job cannot possibly be effective day in and day out. There are too many discouraging factors associated with teaching that is difficult enough on a teacher who absolutely loves what they do, much less on one who doesn’t have the drive, passion, or enthusiasm for it. On top of that, kids are smarter than what we give them credit for. They will spot a phony quicker than anyone and thus destroy any credibility that the teacher may have. b)An effective teacher demonstrates a caring attitude. Even teachers who love their job can struggle in this area, not because they don’t care, but because they get caught up so much in the day to day routine of teaching that they can forget that their students have lives outside of school. Taking the time to get to know a student on a personal level takes a lot of time and dedication. There is also a line that no teacher wants to cross where their relationship becomes too personal. Elite teachers know how to balance this without crossing that line and once a student believes the teacher truly cares for them, then there is no limit to what that student can achieve. c)An effective teacher can relate to his or her students. The best teachers work hard to figure out how to relate to each of their students. Common interest can be hard to find, but exceptional teachers will find a way to connect with their students even if they have to fake it. For instance, you may have a student who is a Lego fanatic. You can relate to that student if you do something as simple as ordering a Lego catalogue and then going through it and discussing it with that student. Even if you have no actual interest in Lego’s, the student will think you do and thus naturally create a connection. d)An effective teacher is willing to think outside the box. There is no one set cookie cutter way to teach. A cookie cutter approach would likely be boring for both teachers and students. What makes teaching so exciting is that kids learn differently, and we have to find and utilize different strategies and differentiated learning to reach every student. What works for one student, will not work for every student. Teachers have to be willing to be creative and adaptive in their lessons, thinking outside the box on a continual basis. If you try to teach every concept in the same manner, there will be students who miss out on key factors because they aren’t wired to learn that way. e)An effective teacher is an excellent communicator. To be the best possible teacher you must be an effective communicator. However, in this area you are not just limited to being a skilled communicator to your students although that is a must. You must also be a strong communicator with parents of your students as well as your faculty/staff team within in your building. If you have a difficulty communicating with any of these three groups, then you limit your overall effectiveness as a teacher. f)An effective teacher is proactive rather than reactive. This can be one of most difficult aspects for a teacher to conquer. Intense planning and organization can ultimately make your job all the more less difficult. Teachers who plan ahead, looking for aspects that they might have issues with, and proactively looking for solutions to solve those problems will have less stress on them, than those teachers who wait until a problem arises and then tries to address it. Being proactive does not replace being adaptive. No matter how well you plan, there will be surprises. However, being proactive can cut down on these surprises tremendously, thus making you more effective overall. g)An effective teacher strives to be better. A teacher who has grown complacent in what they do is the most ineffective kind of teacher. Any teacher who is not looking for new and better teaching strategies isn’t being an effective teacher. No matter how long you have taught, you should always want to grow as a teacher. Every year there is new research, new technology, and new educational tools that could make you a better teacher. Seek out professional development opportunities and try to apply something new to your class every year. h)An effective teacher uses a variety of media in their lessons. Like it or not we are in the 21st century, and this generation of students was born in the digital age. These students have been bombarded by technological advances unlike any other generation. They have embraced it, and if we as teachers do not, then we are falling behind. This is not to say that we should eliminate textbooks and worksheets completely, but effective teachers are not afraid to implement other forms of media within their lessons. i)An effective teacher challenges their students. The most effective teachers, are often the ones that many students think are the most difficult. This is because they challenge their students and push them harder than the average teacher does. These are the teachers who are often students’ least favourite teachers at the time, but then later on in life they are the ones that we all remember and want to thank, because of how well they prepared us for life after our time with them. Being an effective teacher does not mean you are easy. It means that you challenge every one of your students and maximize your time with them so that they learn more than they ever thought they could learn. j)An effective teacher understands the content that they teach and knows how to explain that content in a manner that their students understand. There are teachers who do not know the content well enough to effectively teach it. There are teachers who are truly experts on the content, but struggle to effectively explain it to their students. The highly effective teacher both understands the content and explains it on level. This can be a difficult skill to accomplish, but the teachers who can, maximize their effectiveness as a teacher. III. Effective teaching strategies Six keys to classroom Excel a) Interest and explanation – â€Å"When our interest is aroused in something, whether it is an academic subject or a hobby, we enjoy working hard at it. We come to feel that we can in some way own it and use it to make sense of the world around us. † (p. 98). Coupled with the need to establish the relevance of content, instructors need to craft explanations that enable students to understand the material. This involves knowing what students understand and then forging connections between what is known and what is new. b) Concern and respect for students and student learning – Rams den starts with the negative about which he is assertive and unequivocal. â€Å"Truly awful teaching in higher education is most often revealed by a sheer lack of interest in and compassion for students and student learning. It repeatedly displays the classic symptom of making a subject seem more demanding than it actually is. Some people may get pleasure from this kind of masquerade. They are teaching very badly if they do. Good teaching is nothing to do with making things hard. It is nothing to do with frightening students. It is everything to do with benevolence and humility; it always tries to help students feel that a subject can be mastered; it encourages them to try things out for themselves and succeed at something quickly. † (p. 98) c) Appropriate assessment and feedback – This principle involves using a variety of assessment techniques and allowing students to demonstrate their mastery of the material in different ways. Morality vs. Reality The story "Battle Royal" is the key in understanding and seeing the relationship between morality and reality. The characters in this story, namely the grandfather and his grandson, reveal to us their individuality, principles, morals, and ethics doing so they unfold a map that reveals their mental reality. Because their principals, morals and ethics reveal to us their mental reality, then their mental reality discloses the reality of the society in which they live in. The young boy’s journey toward the light (truth) is started a long time ago. However in the beginning he is unable to get on the right course, due to the wrong advice he is given by different people; he says it as "All my life I was looking for something, and every were that I turned someone tried to tell me what it was. I accepted their answers too, though they were often in contradiction" (448). Each time that he accepts their advice he is little by little pushed off the right track. It is not until he realizes that he is searching for himself, and instead of asking others questions, he needs to ask the questions to himself. Once he discovers whom to turn to, he begins a long and difficult journey in which he realizes that he is a unique person, he puts it as, "I am nobody but myself."(449). This means that he is unique and he is who he is, black. However before he comes to this enlightenment he discovers that he is an "invisible man"(449). He marks himself invisible because in the society in which a person is unheard and unseen by others is invisible. At that point the boy’s problem is clear. He is a black boy in a White men's world, in which he is not seen or heard. Yet he still does not know what to do about it, well at-least not until he hears his grandfather’s words to his father: Son, after I'm gone I want you to keep up a good fight. I never told you, but your life is a war and I have been a traitor all my born days, a spy in the enemy's country ever since I give up my gun back in the Reconstruction. Outliers by Malcom Gladwell Essay

In Malcolm Gladwell’s The Outliers, his goal is to convince the reader that â€Å"people don’t rise from nothing† and that â€Å" we do owe something to parentage and patronage. † Although certain people’s success requires prerequisites of talent and knowledge. I agree with Gladwell that it is not solely because of these talents that these people are successful. However, their success most often is dependant on one’s past good fortune. For example, when or where one was born and raised, one’s cultural background and family legacies, one’s schooling, and many other factors, create opportunities for success where these talents can be utilized. Although some people are thought to have risen from nothing or to have gone from rags to riches, the fact is no one is capable of creating their own success without the help of others and good fortunes along the way. In this passage, a point that Gladwell points out is that success can be created by parentage and patronage, hidden advantages and opportunities, cultural backgrounds and family legacies. An example of the importance of one’s cultural backgrounds and family influence is the way we are raised. Our parents, as our first teachers have a big role in who will become in our lives; they teach us how to interact with other people, how to act in certain situations and how to present ourselves to others. The different religious and cultural backgrounds of our parents, and also the way our parents were raised have an enormous impact on the way our parents raise us. As a parent, the balancing of strictness, pressure, giving, loving, helping, and withholding, among other factors can be difficult, with the question being what balance is the best to raise a child. Because we are all raised in different ways everyone has different views on how to raise a child based on their knowledge of how they were raised. This proves that the way we are raised can make the difference in our success. An example of how parentage and patronage play a role in one’s success is sometimes evident in schooling. Everyday people acquire things they may not deserve because of their family and who they may know. A very common example of this is the use of legacies for admission into a university. Students use their parental legacies at schools all the time and depending on the school this can have an impact on the student’s admission to the school. Another strategy applicants use to help their admission into a school is to search for someone to write their recommendation letter that will have the most amount of influence on the admissions office. Another example of how â€Å"whom you know† can make the difference in one’s success is when looking for jobs. If your aunt, father, grandfather or friend owns or works at a successful business and they help you get a job, sometimes right out of college even if you aren’t as qualified as someone else who wants the job. This way, you are getting an opportunity that you wouldn’t have had otherwise that could make the difference of your success. Therefore, everyday instances like using legacies to get into college, inquiring jobs because of nepitism, or even getting moved up to an honors class because your mom called the school can create success for our futures. In this excerpt from Malcom Gladwell’s The Outliers, Gladwell makes the point that success requires help from others and good fortune to get ahead and become successful. I think whether we realize it or not we are always using advantages we have to get ahead in our own lives, in order to set us up for a more successful future.

Evaluation of Children’s Aid Society Mission Statement The Children’s Aid Society is a 501Â ©3 children’s services agency that helps children in poverty to succeed and thrive. They do this by providing comprehensive support to children and their families living in high needs New York City neighborhoods (website). This organization has developed services that ensure children have access to programs that promote health and wellness as well as social-emotional development skills. They also strive to make sure that children attend college. The Form 990 on page 2 does not provide any further detailed information. With the available information from the mission statement on the website, as well as Form 990 part I and III, it is difficult to evaluate this nonprofit organization’s mission. The quality and the quantity of the available information from the website, and Form 990 is difficult to evaluate because the mission statement was not stated in the annual report. The Children’s Aid Society provides information about its programs on their website. The Form 990 and the annual report are very similar because it is almost the same information. They provide numbers about how many people they serve and the impact the programs have on the children and families. The website and the annual report 2013 both mention this information. Effectiveness From the information obtained, the website provides the effectiveness of the programs from the website, the annual report and the Form 990. The programmatic goals state how many children receive service from various programs. The website provides the number of children served by the organization. The Children’s Aid Society has three major programs that include Early Childhood (0-5), School Age (5-13), and Adolescence (14-18). Early Childhood- The program’s goals are preparing young children for school success through physical, social, emotional, and cognitive development. The core services they provide are Early Head Start for children ages 0-3, and Head Start and Early Learn Day Care for ages 3-5. School Age- The program’s goal is to promote physical, social, and emotional well-being as key factors for high school graduation and college success. This program serves to engage children, families, schools, and communities through a focus on academics, services, support, and opportunities. The core services include out-of-school time programs in Children’s Aid Community Centers and schools, summer camps, athletics, and the national center for community schools that provide assistance to developing a community school model nationally and internationally. Adolescence-The goals of this program are to enhance young people’s physical, social, and emotional competencies as well as improving their academic performance and preparing them for successful careers and gaining financial independence. According to the Form 990, the core services that the organization provides are the Carrera adolescent pregnancy prevention program, which meets the top-tier evidence of effectiveness standards by the coalition for evidence-based policy. The EXCEL college support program assists young people to enter and complete college. The HOPE Leadership Academy provides wrap-around support and develops leadership through a peer education model. They also provide teen employment services such as AmeriCorps internships and the summer youth employment program. Efficiency From the information obtained from the three sources, it is very difficult to determine whether these programs have been efficient in the programs that they administer. The three most expensive programs are school age, adolescence, and early childhood. School-age- The total cost of this program is $18,843,068. The annual report also does not state how many adolescents were served and at what cost. However, the annual report states that the program reduced teen pregnancy by 50 percent. The EXCEL college support program does not provide information on the number of students served as well as how much it costs. The annual report states that more than 90 percent of EXCEL students graduate high school and go on to college. There is no information on how many students are in the program. The quality and the quantity of available information is not very satisfying because there should be detailed information on the exact costs of each major program within the program. Early Childhood- The total cost of this program is $11,612,396. According to the Form 990 page 2, the organization mentions the Early Head Start program. The program provides numbers on its website stating that each family receives a minimum of 32 home visits a year for 90 minutes each. However, it does not state the number of families served. The 2013 annual report does not contain any specific numbers about the program. The quality and quantity of available information are not satisfying because there are no exact costs of how much program costs. According to the nonprofit’s annual report, the management and general administration costs increased to $7,378 in 2012 compared to $6,546 in 2011. This organization increased its expenses, which means that they are spending money on ways to increase mission impact and evaluate programs that may or may not work. The costs of the programs from the Form 990 do not match the financial statement in the annual report. In Form 990, it states larger expanses and is not specific about where the money went. In the annual report, the expenses are more specific but the costs seem to be smaller in Form 990. This shows that the organization is not efficient in its programs. It also shows that they may not have provided other essential information. Governance The Form 990 claims that the Children’s Aid Society has a governing body where the organization documents all meetings. It also states that the committees have the authority to represent the organization on behalf of the governing body. This organization also has different policies. The Form 990 states that the organization consists of 31 Board Members. These members also have the power to elect other members to the governing body. The Children’s Aid Society has executive centrality governance. Finances The organizations current total revenue is $117,154,454 and its current total expense is $121,692,560. This organization is running a deficit rather than a surplus. The organization is losing its revenue stream and its assets will not cover it for a long time. The organization is fiscally unsustainable. The organization has net unrestricted assets total of $258,063,545 and its restricted assets is a total of $13,848,823. According to the Form 990, the organization received a total of $31,966,571 in contributions and grants. However, it only spent $31,966,571 on fundraising expenses. After dividing the expenses by costs, a total cost of raising a dollar was .09, which is very low. The salary of the Chief Executive Officer is $408,431.00 and it is too much. The average salary according to www.payscale.com states that the average salary is $100,000 for a Chief Executive Officer of a nonprofit organization. After calculating the organization’s program expanse it came up to be .88 ratio from dividing its total program service expenses by its total functional expenses. After analyzing the Children’s Aid Society, I determined that this organization is not worthy of a significant contribution because it is not transparent in providing information to the public. Even though it has a high mission impact in helping children get out of poverty, financially it is starting to become unsustainable in its assets and revenues. This shows that the organization is mismanaging its finances spending. This organization does not earn the seal of approval because the potential donor wants to donate to an organization that is impact-oriented and achieves results cost-effectively, which this organization does not achieve.
